TRAiDESMEN LLC — Terms of Service
Effective Date: June 3, 2026
Please read these Terms of Service ("Terms") carefully before using the TRAiDESMEN platform. By subscribing to or using TRAiDESMEN's services, you ("Customer" or "you") agree to be bound by these Terms.
1. Definitions
"TRAiDESMEN," "we," "us," or "our" means TRAiDESMEN LLC, a South Carolina limited liability company. "Platform" means the TRAiDESMEN AI-powered operating system, including all software, applications, APIs, and related services. "Services" means all features made available through the Platform, including AI phone answering and appointment booking, Google Calendar integration, weekly call summary emails, voice-to-quote and PDF generation, payment processing via Stripe, Google review automation, and AI receipt scanning. "Subscription Plan" means the paid tier (Essential at $399/month, Agency at $799/month, or All-In at $999/month) to which Customer subscribes. "User Data" means any data, content, or information submitted by Customer or its end users through the Platform.
2. Acceptance of Terms
By creating an account, initiating a free trial, or paying for a Subscription Plan, you represent that: (a) you are at least 18 years of age; (b) you have the authority to bind the business entity you represent; and (c) you have read, understood, and agree to these Terms and our Privacy Policy.
3. Subscription Terms and Billing
3.1 Subscription Plans
TRAiDESMEN offers three monthly Subscription Plans: Essential — $399/month, Agency — $799/month, All-In — $999/month. All prices are in U.S. dollars.
3.2 Billing Cycle
Subscriptions are billed monthly. Your billing cycle begins on the day your paid subscription starts or the day after your free trial ends if you convert.
3.3 Payment Processing
All payments are processed through Stripe, Inc. TRAiDESMEN does not store full credit card numbers; payment data is handled by Stripe in accordance with PCI-DSS standards.
3.4 Failed Payments
If a payment fails, TRAiDESMEN will notify you and may retry the charge. If payment remains outstanding for more than seven (7) calendar days, TRAiDESMEN reserves the right to suspend or terminate your access.
3.5 Price Changes
TRAiDESMEN may modify pricing at any time with at least thirty (30) days' written notice via email.
4. Free Trial
TRAiDESMEN offers a thirty (30) day free trial for new customers. At the end of the Trial Period, your account will automatically convert to the Subscription Plan you selected and your payment method will be charged unless you cancel before the Trial Period expires. Free trials are available once per business entity.
5. Cancellation Policy
5.1 How to Cancel
You may cancel your subscription at any time by contacting support@traidesmen.ai. Cancellations must be submitted before your next billing date.
5.2 Effect of Cancellation
Upon cancellation, your subscription will remain active through the end of the current billing period. TRAiDESMEN does not provide prorated refunds for partial months.
5.3 Data Retention After Cancellation
Following cancellation, TRAiDESMEN will retain your User Data for thirty (30) days during which you may request an export. After that period, your data will be deleted unless retention is required by applicable law.
5.4 Termination by TRAiDESMEN
TRAiDESMEN may suspend or terminate your account immediately if you materially breach these Terms, engage in fraudulent or illegal activity, or continued operation poses a risk to TRAiDESMEN or other users.
6. AI-Generated Content Disclaimer
The TRAiDESMEN Platform uses artificial intelligence to provide features including automated phone answering, appointment booking, voice-to-quote generation, call summaries, and AI receipt scanning. TRAiDESMEN does not warrant that AI-generated content is accurate, complete, or appropriate for your specific business circumstances. You are solely responsible for reviewing and verifying all AI-generated content before relying on it. Voice-to-quote outputs are AI-generated estimates and do not constitute binding contracts or final pricing commitments.
7. Data Usage and Privacy
Your use of the Platform is governed by TRAiDESMEN's Privacy Policy, incorporated into these Terms by reference. You retain ownership of all User Data you submit to the Platform.
7.1 Call Recording and Voice Data
The AI phone answering feature records and transcribes customer calls. An in-call disclosure is played to callers indicating the call may be recorded. You are solely responsible for complying with all applicable federal and state call recording and wiretapping laws, including two-party consent laws where applicable.
7.2 SMS and Automated Text Communications
You are solely responsible for ensuring you have obtained valid prior express written consent from each recipient before any automated text is sent, as required by the TCPA. TRAiDESMEN does not independently verify customer consent and shall have no liability for TCPA violations arising from your use of SMS features.
7.3 Third-Party Integrations
The Platform integrates with Google, Stripe, Twilio, Vapi, Anthropic, and others. Your use of those integrations is subject to those third parties' terms and privacy policies.
8. Acceptable Use
The Platform is provided exclusively for lawful use in connection with the operation of independent trades businesses. You agree not to use the Platform for any unlawful purpose, reverse engineer the Platform, send unsolicited communications, attempt to gain unauthorized access, resell or sublicense the Platform without written consent, or use the Google review automation feature in any manner that violates Google's Terms of Service or the FTC's Endorsement Guides.
9. Intellectual Property
The Platform, including all software, algorithms, designs, trademarks, and content created by TRAiDESMEN, is the exclusive property of TRAiDESMEN LLC. You retain all ownership rights to User Data and content you create using the Platform.
10. Third-Party Services
The Platform integrates with third-party services including Google Workspace, Stripe, Twilio, Vapi, and others. TRAiDESMEN is not responsible for third-party services, including downtime, errors, or changes in functionality. Customers on the All-In plan receive bookkeeping services fulfilled by a licensed third-party CPA firm. TRAiDESMEN is not a licensed accounting or tax advisory firm.
11. Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRAIDESMEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TRAIDESMEN'S TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to defend, indemnify, and hold harmless TRAiDESMEN LLC and its members, officers, employees, and agents from and against any claims arising out of your use of the Platform, your violation of these Terms, your violation of any applicable law, any AI-generated content you acted upon without independent verification, or your failure to comply with call recording consent requirements.
13. Modifications
TRAiDESMEN reserves the right to modify these Terms at any time with at least fourteen (14) days' notice via email before changes take effect.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of South Carolina. Any legal action shall be brought exclusively in the state or federal courts located in South Carolina. Before filing any legal claim, both parties agree to first attempt informal resolution. You waive any right to pursue disputes on a class-wide basis.
15. General Provisions
These Terms constitute the entire agreement between you and TRAiDESMEN with respect to the Platform. If any provision is found unenforceable, the remaining provisions remain in full force. You may not assign your rights under these Terms without TRAiDESMEN's prior written consent.
